The "MOEMI Terms of Use" (hereinafter referred to as "these Terms And Conditions") outline the conditions for the provision of the service "MOEMI" (hereinafter referred to as "MOEMI") offered by Relic, Co. (hereinafter referred to as "the Company"), as well as the rights and obligations between the users of MOEMI (hereinafter referred to as "the Customer") and the Company. In cases where the name or content of the service is changed for any reason, these Terms shall also apply to the modified service. Before using MOEMI, the Customer is required to read the entirety of these Terms And Conditions and agree to them.

Please note that the content of these Terms And Conditions may be changed in accordance with Article X, so please refer to the latest Terms And Conditions when using MOEMI.

Article 1 Scope of Application

  1. The Customer who uses MOEMI shall agree to the following items in addition to these Terms And Conditions and use MOEMI. (1) The Customer who has completed the membership registration process in accordance with the prescribed procedures of the Company after agreeing to these Terms And Conditions (hereinafter referred to as “the MOEMI Member”) In the event that the provisions of these Terms And Conditions differ from the provisions of the Terms of Use, Card Management Terms of Use, and Mobile App Terms of Use, the provisions of these Terms And Conditions shall take precedence.
  2. The Company shall be able to determine the content of the services provided at its discretion, or change them at any time.

Article 2 Eligibility for Use The Company grants the Customer eligibility to use MOEMI if the Customer has agreed to and complied with the terms of Article 1.

Article 3 Language These Terms and Conditions are written in English. If these Terms and Conditions are translated into a language other than English, and there is a discrepancy or inconsistency between the English version and the other translation, the English version shall apply.

Article 4 Overview of MOEMI MOEMI is a service that allows the Customer to order products or services (collectively referred to below as “the Products, etc.”) specified by the Company via a web application, and to eat or drink at a store specified by the Customer at the time of ordering (referred to below as “the Designated Store”).

Article 5 Handling of Personal Information

  1. Privacy Policy Please refer to the Company's Privacy Policy for information on how the Company collects, processes and discloses information from the Customer.
  2. Informative Data In order to provide better services to the Customer using MOEMI, the Company may collect and use information about the Customer, such as cookies, web beacons, device identifiers, and location information (hereinafter collectively referred to as “Informative Data”). For more information on Informative Data, please refer to the “Privacy Policy”.

Article 6 Security The MOEMI Member registration uses the most reliable SSL (Secure Socket Layer) encryption technology on the Internet, and the information sent is encrypted so that it cannot be viewed by third parties. In addition, measures such as the introduction of anti-virus software are also taken to protect against computer viruses.

Article 7 Registration and Management of Login Account, etc.

  1. The Customer shall be responsible for the registration, management, etc. of the login account and password (hereinafter referred to as “Login Account, etc.”). The Company shall not be liable for any damages caused by the Customer's inadequate management, operational errors, use by a third party, etc. In addition, the Customer shall use the services related to the Login Account, etc. (including services operated by parties other than the Company, and the same shall apply hereinafter) at their own risk, and shall comply with the terms and conditions stipulated by the operator of the relevant service when using said service.
  2. The Company shall be liable for damages caused by the use of services related to "Login Account, etc." (including but not limited to damages arising from insufficient management by the Customer, misuse, or use by a third party) and/or for disputes arising between the Customer and the operator of such services only to the extent of ordinary damages that would typically arise (excluding lost profits or damages arising from special circumstances), provided that the Company’s liability for breach of contract or tort is recognized due to the Company's negligence (excluding gross negligence). However, this limitation shall not apply in cases where such damages or disputes are attributable to the Company's willful misconduct or gross negligence.

Article 8 Equipment Required for Use In order to use MOEMI, the Customer must access the web. The Customer is responsible for preparing and operating the necessary equipment and software at their own expense, and the Company is not involved in any way with the Customer's preparations or methods for accessing the web.

Article 9 Changes and Suspension of Service The Company may change MOEMI, which is provided to the Customer, at its own discretion. Additionally, please note that MOEMI may be suspended in the event of disasters, accidents, or other emergencies. In cases where MOEMI is changed or suspended without prior consent from the Customer, and if liability for breach of contract or tort is recognized due to the Company's negligence (excluding gross negligence), the Company shall only be liable for ordinary damages that would typically arise (excluding lost profits or damages arising from special circumstances). However, this limitation shall not apply if such damages are attributable to the Company's willful misconduct or gross negligence.
